1. Agreement to Terms

By accessing or using Sidequest Board ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

These Terms constitute a legally binding agreement between you and Sidequest Board regarding your use of the Service. Please read them carefully.

2. Description of Service

Sidequest Board is a curated job board platform that aggregates freelance job opportunities from public sources. We provide:

• Job listing aggregation and curation
• Job search and filtering tools
• Job saving and tracking features
• AI-powered reply suggestions (Pro tier)

We are a job discovery platform only. We do not employ freelancers, hire for projects, or facilitate payments between clients and freelancers.

3. Account Registration

3.1 Eligibility

You must be at least 16 years old to use this Service. By creating an account, you represent and warrant that you are eligible to enter into a binding contract.

3.2 Account Information

When you create an account, you must provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We reserve the right to terminate accounts that provide false information or violate these Terms.

4. Subscription and Payments

4.1 Free and Pro Tiers

We offer both free and paid subscription tiers. Features and limitations of each tier are described on our Pricing page and may be updated from time to time.

4.2 Billing

Pro subscriptions are billed through Dodo Payments. By subscribing, you agree to pay all fees in accordance with the pricing displayed at checkout. All payments are processed securely by Dodo Payments. We do not store your full credit card information.

4.3 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. No refunds will be provided for partial months.

4.4 Refunds

We offer a 30-day money-back guarantee for new subscribers. If you are unsatisfied with the Service, contact us at hello@sidequestboard.app within 30 days of your first payment for a full refund. After 30 days, refunds are at our sole discretion.

5. User Conduct

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others (intellectual property, privacy, etc.)
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated means (bots, scrapers) to access the Service without permission
• Interfere with or disrupt the Service or servers
• Harvest or collect email addresses or other contact information without consent
• Post or transmit any content that is illegal, harmful, threatening, or discriminatory
• Impersonate any person or entity

We reserve the right to terminate or suspend accounts that violate these rules.

6. Intellectual Property

6.1 Our Content

The Service and its original content, features, and functionality are owned by Sidequest Board and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works without our express written permission.

6.2 Job Listings

Job listings are aggregated from public sources. We do not claim ownership of the job content. Original job postings remain the property of their respective authors. We provide attribution and links to original sources where applicable.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• The accuracy, completeness, or usefulness of job listings
• The reliability or legitimacy of employers posting jobs
• Uninterrupted or error-free service
• That defects will be corrected
• That the Service is free of viruses or other harmful components

We do not guarantee that you will find employment or clients through our Service. We are not responsible for any employment decisions, contract terms, or payments between you and employers/clients.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIDEQUEST BOARD SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from unauthorized access to your account
• Damages resulting from your reliance on any job listing
• Damages resulting from any employment relationship or contract
• Any third-party content or conduct

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE PAST 12 MONTHS, OR $100 USD, WHICHEVER IS GREATER.

9. Indemnification

You agree to defend, indemnify, and hold harmless Sidequest Board and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

10. Third-Party Links

Our Service may contain links to third-party websites or services that are not owned or controlled by Sidequest Board. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You acknowledge that we are not responsible for any damage or loss caused by your use of or reliance on any third-party content, goods, or services.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Non-payment of subscription fees
• Fraudulent or abusive activity
• Upon your request

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive, including but not limited to: intellectual property rights, warranty disclaimers, indemnity, and limitations of liability.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Sidequest Board operates, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within that jurisdiction.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

15. Entire Agreement

These Terms constitute the entire agreement between you and Sidequest Board regarding the Service and supersede all prior agreements, understandings, and representations.
